NHS Staff Probed for Unauthorised Access to Deceased Teen’s Medical Records

A troubling investigation has been launched at Bristol Foundation NHS Trust following revelations that staff may have accessed private medical records of a deceased patient without proper consent. Paula McGowan, the mother of Oliver McGowan, who died at the age of 18, was shocked to learn that several staff members accessed her son’s records for years after his untimely death in 2016.

Unauthorized Access to Sensitive Records

Oliver, an autistic teenager with mild learning disabilities and epilepsy, passed away after receiving anti-psychotic medication at Southmead Hospital, which his family had advised against. Despite the family’s warnings, the drug was administered, unfortunately leading to his death. The bereaved mother was informed that since her son’s passing, numerous staff had perused his medical data, raising concerns about privacy breaches.

Five staff members are under scrutiny, with three nurses currently facing formal inquiries. Another doctor, who has since left the trust, has self-reported the matter to the General Medical Council. Additionally, another employee’s involvement is under separate review. The Bristol NHS Trust has expressed regret over the incident and has notified the Information Commissioner’s Office in a bid to address the situation.

Broader Implications and Past Incidents

This investigation is not an isolated case. Recently, the Health Services Journal revealed that approximately 214 NHS staff were dismissed and 2,000 faced disciplinary action over the last five years for unauthorized accesses to patient data. Concerns about data privacy within the NHS have been heightened, with NHS England issuing warnings that such breaches could lead to severe repercussions, including termination of employment or legal action.

Examples of inappropriate data access include cases involving victims of violent attacks and incidents with public health implications. These breaches highlight significant concerns regarding patient confidentiality within the NHS network.

The Ongoing Investigation

The investigation remains ongoing, with Paula McGowan expressing extreme disappointment and distress upon learning about the breaches. She noted that there are sensitive details within her son’s medical record that should remain confidential. Efforts to internally review the access history to Oliver’s records have shown that much of it was directly linked to legal actions and inquests related to his passing, but unauthorized access by personnel not directly linked to his care poses severe ethical questions.

The Bristol NHS Trust is committed to thoroughly investigating these matters, ensuring accountability, and enhancing data security measures to prevent future breaches of this nature.
